We have drafted a MiCA Non-Applicability Statement for DigiByte, confirming that $DGB does not fall within the scope of the Markets in Crypto-Assets Regulation (EU 2023/1114). 🔹DigiByte has no identifiable issuer within the meaning of Article 3(6) MiCA, 🔹DigiByte was not offered to the public and has never conducted an ICO or fundraising, 🔹and therefore DigiByte is not subject to the MiCA Whitepaper requirement under Articles 4–6. 🔹This position is supported by an independent legal opinion issued by Riveles Wahab LLP (New York) on July 17, 2018, concluding that DigiByte is a decentralized blockchain with no central issuer and does not qualify as a security or investment contract.
